Terms and Conditions
These terms and conditions govern your rights regarding Yoga with Clare teacher training courses and your right to use the materials from these courses, including use of recordings, learning resources, and/or any products or services acquired in relation to courses and programs offered by Yoga with Clare and the Joyful Yoga Academy.
In enrolling in one of our courses, you are deemed to have read and personally agreed to the Terms and Conditions.
Teacher training course requirements
Teacher training requires commitment. Trainees are required to attend and participate in all scheduled days of their training course. Where attendance is less than 90% the trainee may be required to repeat those classes, at their own expense in order to finish their course and graduate.
For zoom classes, recordings will be provided, where possible for 7 days after the class, however live attendance is still important in order to gain the most from the course and is required.
In case of illness or certain extenuating circumstances, a recording of the missed class may be made available for up to 21 days.
Recordings, class notes and manuals.
All course materials are copyright to YogawithClare, unless stated. Course materials from guest experts are the intellectual property of that guest expert. In downloading any content from any of our courses to your computer, you do not receive any ownership rights to such content and by downloading any content you agree not to use the content for any unlawful purpose and you agree that your use of the Course materials is only for your personal use and not for any commercial or other use contrary to these Terms and Conditions and our legal rights in respect of copyright.
You agree that when you access the learning materials/ online courses you will not reproduce, distribute in person, publish, republish, print, upload to any third party, post on any social media site or forum, or distribute or modify or otherwise deal with any content in the Website in whatever format, personally or otherwise, and/or provide it, or any part of it, to a third party that would otherwise infringe our intellectual property rights.
Learning material may not be reproduced without written agreement and remains the intellectual property of the course tutor unless otherwise stated.
You agree that in downloading any service or product from our courses, you will not rent, lease or lend it to a third party nor use it for your own teacher training programs without written permission.
Code of conduct on yoga teacher training days
Punctuality, participation and good communication are requirements for all teacher training programs.
In addition trainees are expected to keep up with their self practice, journaling, teaching practice and other course assignments and in a case where they are experiencing difficulties with this, communicate with their tutors.
Complaints procedures
In the event that there is a problem you should first talk to your course tutor on the day. If that does not resolve the issue you can email clare@joyfulyogaacademy.com outlining the complaint and where possible how you would suggest the issue might be resolved. Complaints will be handled within four weeks and in the strictest confidence.
If you experience an injury during training you should notify your teacher immediately.
GDPR
As an ethical yoga practitioner we agree never to sell your data to anyone. Your contact details may be shared with your classmates with your permission. For teacher training courses you agree that as a student of the Teacher Training course, you consent to your contact details (name, email and phone number) being passed on to our accreditation and insurance partners, Yoga Alliance Professionals. This means allowing YAP to contact you directly and invite you to register as a Trainee and Teacher. You have the option of opting out of this registration process. You also consent to your name being added to our mailing list. You can opt out of this at any time.
Yoga with Clare Teacher Training is satisfied that Yoga Alliance Professionals have appropriate and adequate technical and organisational measures in place to protect the security of your data. They will never share your data with anybody else.
Your information archived will be stored for 7 years from the date of purchase and/or registration on our courses.
Cancellation Policy
Teacher training is a deeply personal journey. For that reason, from day 1 to day 5 on the training course, and in a case where the tutor deems fit, a trainee may be advised to leave the course. In this case a full refund will be issued, no questions asked. In a case where the trainee chooses to leave in the first 5 days a full refund of fees will be given less the deposit.
Class sizes and cancellations / postponement
All classes are to a maximum size of 16 students. The minimum number may vary depending on the class/course/workshop. Generally 6 is our minimum number. If a class / course needs to be cancelled because of a lack of bookings we will endeavour to notify you at least a week in advance and where possible to accommodate you on an alternative course. If that is not possible we will refund you all fees paid.
In the case of in person training days that may need to be postponed, for example where there is a status red or orange weather warning in place, covid restrictions or similar, in-person training days will take place live online. In the event that online is not possible they will be postponed to a later date. Every effort will be made to find a time that suits all participants, if you can not attend the new dates you may be able to access a recording and/or book an additional mentor meeting and/or come to that day’s training on the next course with no additional charge.
Certification of teacher training courses
A certificate of attendance may be given where full payment has been received and full attendance and participation has taken place.
Teaching Certification is given where full payment has been received and full attendance and participation has taken place, continuous assessment standards are met and the trainee has demonstrated an aptitude and ability to teach safely.
Return / Refund Policy
Deposits for all courses must be received a minimum of 21 days prior to the course start date to secure your place on the course. The deposit is fully refundable up to 30 days before the course start date.
Cancellations in writing within 5 days of the course start date will be refunded course fees minus the deposit.
Last minute cancellations will forfeit their deposit, however it may be transferred to secure a place on the next course at the discretion of your course tutor.
Course fees can not be refunded once the course has started. However course fees may be transferred to another course, in extenuating circumstances,should your place be deferred at the discretion of your lead tutor.
The full training course fees can be transferred to a new student at any time prior to the start of the course as long as that new trainee has spoken to one of the tutors and is accepted onto the course.
Where you have agreed to a payment plan, course fees are due as laid out in your payment plan. Late payments may result in a late payment fee and/ or delay in your certification.
In the cases of illness or extenuating circumstances, where your course place is deferred, your payment plan may be put on hold at the discretion of your lead tutor.
Whatsapp group, mentor meetings and continued support from tutors
Teacher training courses include whatsapp group support and you are encouraged to ask relevant questions in the group chat. Questions asked in the group during your course will be answered within 5-7 working days. You can access your group any time. Questions asked within your whatsapp group will be answered for a year and a day after your graduation.
You can leave the group at any time. The group is there to support you. Follow your yamas and niyamas. Bullying, hate speech etc. will not be tolerated and may mean you can not be certified as a teacher. No advertising within the whats app group.
Bookings
You agree to provide accurate and truthful details about yourself for the purposes of your registration to any course, and we reserve the right to suspend or terminate your registration if we discover you have, at any time, provided inaccurate, incomplete or misleading personal information.
We reserve the right, at our sole discretion, to terminate your access to the course and withdraw the ongoing support if, in our opinion, you have failed to comply with any of the provisions of these Terms and Conditions.
Payments
In purchasing any product or services from YogawithClare or the Joyful Yoga Academy (“the Purchase”) you agree to:
(a) pay using a valid credit card or other form of payment, Revolut, bank transfer or cash as we may allow);
(b) provide us with current and complete information as detailed in the purchase order form including full legal name, telephone number, email address, credit card details and billing information as required and without limiting any of our rights and remedies if we discover or believe that any information provided by you is inaccurate or incomplete, we reserve the right to refuse to continue with your Purchase, or put on hold or terminate your access to the website, the Programme or any of the services or products provided by us at any stage at our sole discretion and you forfeit any right to a refund of any payment made by you for the Purchase;
(c) pay all costs, fees, charges, applicable taxes and other charges as may be incurred in respect of the Purchase (“the costs”); and
(d) all costs are in Euros unless otherwise indicated.
If you choose to participate in a payment plan you agree to complete the payment plan in full and on time. Late payments may result in an additional admin fee of €25.
Special Offers
Special offers or promotions are not valid in conjunction or combination with other promotions.
Medical Conditions
Yoga and meditation are not a high risk activity, however as with every activity there is some risk. You assume the risk of your own physical condition, your past and current medical issues/injuries/illnesses or medication that may affect your ability to take a class. Yoga is not a substitute for medical attention, examination, diagnosis, or treatment. Where you have concerns you should consult a physician or other relevant medical professional prior to practising.
It is your responsibility to notify the teacher of any serious illness or injury before every yoga class. You are your own responsibility on the mat. You should not perform any postures where you feel they may cause damage of any kind. If at any time during the class, you feel there is an issue, come out of the pose. Communicate it with your tutor.
Your tutor will do their best to guide you with yoga practices that will benefit you.
Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Ireland and you agree to the non-exclusive jurisdiction of the Courts of that jurisdiction and any appeals from those Courts.
Missed attendance policy or joining extra classes
In the case where trainees miss classes they may be able to make up their attendance on a future course. It is their responsibility to contact Clare at the Joyful Yoga Academy and find out when and where those classes take place and register for them. They will be able to enroll on the course a second time with a small additional re-enrolment fee of €100 plus any difference in cost fees.
If they miss days again and decide to enroll on a third course they will be charged 50% of their original course fee. If the course fee has changed they will have to pay the difference.
Trainees who successfully complete the course but wish to repeat a class or course may also do so at the discretion of their tutor. Should you feel you need extra support on or after the course, please communicate that directly with Clare Bassett before the final date of your course. Every effort will be made to support you.
Unfortunately under no circumstances can refunds given for missed classes due to illness or injury that may occur during a term due to maintaining the ongoing viability of our courses and classes. Every effort will be made to help trainees to keep up with their learning on the course, including recordings of online sessions and sharing notes and timetables. However it can not be understated that live attendance and participation are vital for teacher training programs.
